INTRODUCTION
This Master Waiver and Release of Liability Agreement ("Agreement") is entered into as of the Effective Date above by and between Foster Love Adopt Repeat, a nonprofit organization located at 131 Overhill Drive Suite 116, Mooresville, NC 28117 ("Company" or "FLAR"), and the undersigned Signer (collectively, the “Parties”). The purpose of this Agreement is to establish the terms and conditions under which the Signer voluntarily participates in any programs, events, support groups, childcare services, volunteer activities, or other activities organized or sponsored by the Company (collectively, the “Activities”).

1. VOLUNTARY PARTICIPATION
   The Signer understands and agrees that participation in any FLAR activity, event, or program is voluntary. If volunteering, the Signer affirms they are physically and mentally capable of participating in all assigned activities and will exercise reasonable care for their own safety and the safety of others. If using childcare, the Parent understands that childcare is being offered as a complimentary service to support participation in Foster Love Adopt Repeat activities. The Parent’s decision to utilize childcare is voluntary, and participation is at their own risk.
2. ASSUMPTION OF RISK
   The Signer understands and acknowledges that participation in Company events and activities is voluntary and may involve inherent risks, including but not limited to minor injuries, illness, property damage, or other unforeseen circumstances. By signing this Agreement, the Signer voluntarily assumes all risks associated with such participation, whether or not caused by the negligence of the Company, to the fullest extent permitted by law.
   
   If volunteering, the Signer acknowledges that participation in volunteer activities may involve certain inherent risks, including but not limited to physical injury, illness, property damage, or emotional distress. The Signer assumes full responsibility for any and all risks arising from participation, whether known or unknown.
   
   If using childcare, the Parent acknowledges that, although the Company takes reasonable precautions to ensure safety, participation in childcare activities involves inherent risks, including but not limited to minor injuries, illness, or accidents that may occur despite proper supervision. By signing this Agreement, the Parent voluntarily assumes all risks associated with the Child’s participation.
3. RELEASE AND WAIVER OF LIABILITY
   In consideration of being permitted to participate in activities with the Company, the Signer hereby releases, waives, and forever discharges Foster Love Adopt Repeat, its officers, directors, employees, volunteers, representatives, agents, and affiliates ("Released Parties") from any and all claims, demands, or causes of action arising out of or related to any loss, damage, injury, or death that may occur during participation in Company activities, whether caused by negligence or otherwise, except to the extent caused by the gross negligence or willful misconduct of the Released Parties.
   
   If using childcare, this release applies to any loss, injury, damage, or harm that may occur to the Child during participation in the childcare program, except to the extent caused by the gross negligence or willful misconduct of the Released Parties.
4. INDEMNIFICATION
   The Signer agrees to indemnify and hold harmless the Company and its Released Parties from and against any and all losses, liabilities, claims, damages, or expenses (including reasonable attorney’s fees) arising out of or related to the Signer’s participation in any Company activity, except to the extent caused by the gross negligence or willful misconduct of the Company.
5. CHILDCARE SUPERVISION AND CONDUCT (APPLIES IF USING CHILDCARE)
   If using childcare, the Parent understands that childcare will be provided by responsible staff or trained volunteers but acknowledges that the Company is not a licensed childcare provider. The Parent agrees to:
   • Sign the Child in and out of childcare personally;
   • Inform staff of any allergies, medical conditions, or special needs;
   • Ensure their Child behaves respectfully toward others;
   • Remain on-site during events unless otherwise approved by the Company.
   The Company reserves the right to remove any Child from the program if behavior becomes unsafe or disruptive.
6. MEDICAL CONSENT AND EMERGENCY TREATMENT
   The Signer authorizes the Company, its employees, or volunteers to secure emergency medical care or treatment in the event of injury or illness during participation. The Signer accepts full responsibility for any costs associated with such medical care and releases the Company from any liability arising from that care.
   
   If signing as Parent/Guardian for childcare, the Parent authorizes the Company, its employees, or volunteers to obtain emergency medical care or treatment for the Child if deemed necessary during participation. The Parent agrees to assume all costs associated with such medical care and releases the Company from any liability arising from that care.
7. VOLUNTEER INSURANCE, CONDUCT, AND CONFIDENTIALITY (APPLIES IF VOLUNTEERING)
   If volunteering, the Signer acknowledges that FLAR does not provide health, accident, or medical insurance coverage for volunteers. The Signer agrees that maintaining such coverage is their own responsibility.
   
   If volunteering, the Signer agrees to follow all FLAR rules, instructions, and safety guidelines. The Signer also agrees to maintain confidentiality regarding any personal, sensitive, or private information shared during volunteer activities.
8. PHOTO AND VIDEO RELEASE
   The Signer grants permission to the Company to take and use photographs, video recordings, and other media containing their likeness for promotional, educational, or fundraising purposes in print or digital formats, without compensation. The Signer waives any right to inspect or approve the finished materials.
   
   If signing as Parent/Guardian for childcare, the Parent grants permission for the Child’s image, voice, or likeness to be photographed or recorded during Company events for use in promotional, educational, or fundraising materials, both print and digital, without compensation. The Parent waives any right to inspect or approve such materials.
9. RIGHT TO REFUSE OR REVOKE PARTICIPATION
   The Company reserves the right to refuse or revoke participation at any time if, in its judgment, the Signer’s behavior or participation may cause harm to themselves, others, or the Company’s property.
10. ARBITRATION AND GOVERNING LAW
    Any dispute arising out of or related to this Agreement shall be resolved by binding arbitration before a single neutral arbitrator mutually selected by the Parties. The arbitration shall take place in Mooresville, North Carolina, and the decision shall be final and binding. This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina.
11. SEVERABILITY
    If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
12. ACKNOWLEDGMENT OF UNDERSTANDING
    By signing below, the Signer acknowledges that they have carefully read this Agreement, fully understand its contents, and voluntarily agree to be bound by its terms. The Signer acknowledges that they are giving up substantial legal rights, including the right to sue, and are signing this Agreement freely and voluntarily.

If signing as Parent/Guardian for childcare, signature confirms you are the Parent/Legal Guardian of the child(ren) listed above and consent to their participation in childcare services provided by Foster Love Adopt Repeat.
